Terms & Conditions
Last reviewed: draft — pending business and legal review
These terms govern the use of this website and the services provided by AGP PandD.
Use of this website
By accessing this website you agree to use it lawfully and not to attempt to disrupt, misuse or gain unauthorised access to any part of it. We may update, suspend or withdraw all or part of the website at any time.
Services
We design, build, host and manage digital screens, digital and QR menus, price and service boards, and websites. The exact scope of any engagement is set out in the written proposal, quotation or service agreement accepted by the client, which takes precedence over general website descriptions.
Orders and bookings
- Enquiries submitted through this website are requests for information and do not create a contract.
- A contract is formed only when AGP PandD issues a proposal or order confirmation and the client accepts it in writing.
- Where a service depends on client-supplied content, branding or hardware access, timescales begin once that material has been received.
Pricing
Prices are quoted per proposal and, unless stated otherwise, exclude applicable Spanish IVA. Recurring service, hosting and support fees are billed either annually or monthly in advance. We may revise recurring fees.
Payments
- Online payment methods: Via Stripe.
- Invoices are payable within 30 days of invoice date.
- We may suspend services where invoices remain unpaid after written reminder.
Customer responsibilities
- Providing accurate, lawful content, including prices, allergen and product information.
- Holding the necessary rights or licences for any logos, images, music or other material supplied to us.
- Keeping login credentials secure and ensuring only authorised staff publish content.
- Providing suitable power, internet connectivity and display hardware where required on site.
Intellectual property
The platform, templates, designs, source code and underlying systems remain the property of AGP PandD. Clients receive a non-exclusive, non-transferable licence to use them for the duration of their service.
Website content
Information on this website is provided for general guidance and may change without notice. Examples, screenshots and sample layouts are illustrative and do not form part of any contract.
Third-party services
Our services rely on third-party providers such as hosting, database, email delivery and font providers. We select reputable providers but are not responsible for interruptions or changes outside our control. Any third-party links on this website are provided for convenience only.
Liability
To the fullest extent permitted by law, we are not liable for indirect or consequential loss, loss of profit or loss of data. Our total liability in connection with a service is limited to the fees paid by the client for that service in the twelve months preceding the claim. Nothing in these terms limits liability that cannot lawfully be limited, including liability for death or personal injury caused by negligence or for fraud. Statutory rights of consumers under Spanish and EU law are unaffected.
Cancellations and refunds
- Recurring services may be cancelled with a 30 day written notice, effective at the end of the current billing period.
- Design, setup and installation work already performed is chargeable and non-refundable.
- Consumers contracting at a distance may have a statutory right of withdrawal under Spanish consumer law; where services begin at the consumer's express request, that right may be limited once performance has started.
Changes to these terms
We may update these terms from time to time. The version published on this page at the time you use the website or services is the version that applies.
Governing law and jurisdiction
These terms are governed by Spanish law. Disputes shall be subject to the courts of Andalucia without prejudice to any mandatory consumer protection rules that grant a consumer the right to bring proceedings in their place of residence.
